Managing Mental Health Issues During an Investigation

When complaints of workplace misconduct occur, it is not uncommon for someone to raise ‘mental illness’ as a complicating factor. It may be an issue for the complainant, the respondent, or witnesses. This mental health issue may already be known when the complaint arises, may come up during an investigation, or may emerge as a result of the alleged misconduct. Investigators can take a responsible and measured approach to managing mental health issues during an investigation.

LEARNING OBJECTIVES

Participants will learn:

  • The stages of mental health functioning
  • How to not fear claims of mental health
  • Roles and responsibilities surrounding mental health during investigations
  • Using trauma-informed interview methods
  • How and when to engage health professionals
  • Mental health and credibility assessments
  • Reasonable recommendations and how to advise the organization regarding post-investigation.

Dr. Bob Acton, President, Falcongate Ltd.

Dr. Acton is a Clinical and Consulting Psychologist and Licensed Investigator. He has considerable experience with investigations working as an Ethics Investigator, Practice Review Adviser, Acting Complaints Director, and Chair of the Appeal Panel and Complaint Review Committee for the College of Alberta Psychologists over the last 20 years. He has a wealth of experience with both coaching leaders and consulting on behavioural problems surrounding mental health particularly within the workplace. He now integrates that knowledge and experience into workplace misconduct investigations and human resource consultations.
