Description

Workplace investigations are challenging in any setting, but they become especially difficult when the workplace is already divided, distrustful, and accustomed to conflict. In high-conflict environments, employees may have formed factions, prior complaints may remain unresolved, and leaders may be under pressure to do something, even if they are not sure what to do. All of that can blur the scope of the investigation and complicate the investigator’s role. These dynamics can affect what people report, how they describe events, who is identified as a relevant party, and how the investigator’s neutrality is perceived. Through a practical case study, this program will explore how investigators can recognize when the environment has become relevant to the investigation itself, and what they can do to manage that environment while staying true to their role and responsibilities.

Learning Objectives 

Participants will be able to:

1. Identify characteristics of high-conflict work environments that can complicate workplace investigations.

2. Recognize how high-conflict workplaces can distort fact-finding, witness credibility, scope, and perceptions of neutrality.

3. Set and maintain an appropriate investigation scope when parties or stakeholders seek to expand or redirect the investigation.

4. Apply practical strategies to protect the integrity of the investigation and the investigator's neutrality throughout the process.

5. Recognize the pressures — from parties, stakeholders, and the environment itself — that can pull investigators outside their role and compromise their findings.

Gayle F. Wasserman, Esq. is the principal of Wasserman Law LLP, where she serves as an independent workplace investigator and trusted counselor to organizations navigating complex employee relations issues. Gayle is also the co-founder of Impact Workplace Training, LLC, where she develops and delivers customized workplace training programs for employees, managers, executives, and Human Resources and Employee Relations professionals. Gayle also is a Professional Programs Educator with Cornell University’s ILR School, where she designs and teaches multi-day workshops for HR and ER professionals on best practices for conducting workplace investigations, investigation report writing, EEO and employment law, effective employee relations, harassment prevention, and collaborative problem solving.


Gayle earned her law degree from New York University School of Law, and received her undergraduate degree with honors in Organizational Studies from the University of Michigan.

Amy Duerk specializes in highly sensitive and complex internal investigations and is an Association of Workplace Investigators Certificate Holder (AWI-CH). She follows the highest standards of excellence to perform  neutral, thorough, and trauma-informed  investigations across all industries. Amy has investigated claims of sex- and race-based harassment and discrimination, assault, retaliation, conflict of interest, breach of  fiduciary duty, bullying, embezzlement, and fraud.

Prior to focusing on investigations, Amy defended corporations in civil litigation matters including  employment, fraud, antitrust, multidistrict class action, legal malpractice, insurance coverage, insurance bad faith, product  liability, and contract disputes. As a litigator, she represented both plaintiffs and defendants in state and federal trial and appellate courts.

Amy’s clients have included Fortune 500 companies, including companies in the technology, energy, media and entertainment, gaming, and insurance industries, as well as law firms, non-profit organizations, and individuals.

Amy is licensed to practice in California and Montana, and she is admitted to the U.S. District Courts of California and Montana as well as the U.S. Ninth Circuit Court of Appeals. 

She currently serves on the board of a local food security nonprofit organization, Garden City Harvest.
