Session Description: 

This workshop focuses on practical investigation techniques, where credibility assessment will be considered from a legal perspective, but also from a psychological theories’ perspective. 

Some of the following questions will be considered: 

  • How much importance should be placed upon body language and “demeanour evidence”? 

  • Are investigators naturally skeptical, or naturally inclined to believe the evidence provided by witnesses? 

  • What are the common pitfalls of witness credibility assessment, and how may we avoid them? 

  • What role does cognitive bias play in credibility assessment?  

  • Are credibility assessment techniques impacted by a virtual/remote investigation environment?  

The workshop will include practical scenarios in which attendees will be encouraged to participate. 

Learning Objectives: 

Through attending this session, students will understand and be able to apply the following topics to their investigative practice: 

  • Credibility assessment skills, both in person and virtual

  • Underlying legal and psychological theories and concepts (e.g. demeanour evidence, truth-default theory) 

  • The impact of cognitive bias on credibility assessment

Vanessa is a frequent speaker and trainer on cognitive bias, microaggressions, harassment and discrimination prevention. She has been recognized by peers as a rising star in the legal space and a leader in furthering the cause of equality in her profession as well as in the corporate world in general.

When Vanessa is not focusing on workplace investigation and related advice, she practises labour relations and collective bargaining, mergers & acquisitions, and provides general employment advice to Canadian and international employers, with a focus on the American and French companies expanding operations in Canada.

Peter Matukas is an employment lawyer & external workplace investigator, founder of Matukas Workplace Investigations and is based in Toronto, ON.  Peter has been practicing in the area for over 15 years, joined AWI in 2018 and received the AWI-CH designation in 2018 as well.  Peter regularly presents upon workplace investigations and has authored numerous articles upon workplace investigations.  Peter is currently the convenor of the AWI Toronto Local Circle as well as a co-convenor of the CAWI National Circle for Canada.  Peter is also a member of the AWI Webinars committee.
